SECTION 1: USER AGREEMENTS & CONTRACTS

This section outlines legally binding agreements between Fanz™ Unlimited Network (FUN) L.L.C.™ and its users, content creators, and administrators. These agreements define user rights and obligations, platform policies, legal jurisdiction, and dispute resolution mechanisms.

1.1 Fanz™ Unlimited Network (FUN) L.L.C.™ User Agreement

1.1.1 Legal Basis for the User Agreement

The User Agreement is a legally binding contract between the platform and its users, governed by the following laws and legal principles:

A. Contract Law of the State of Wyoming, United States

• Under Wyoming contract law, a contract is legally enforceable if it includes mutual agreement, consideration, legal capacity, and lawful purpose.
• The FUN User Agreement is considered a clickwrap contract, meaning that by signing up, users explicitly agree to the terms and conditions.
• Case Law: Specht v. Netscape Communications Corp., 306 F.3d 17 (2d Cir. 2002)

confirmed that users must actively accept terms for an agreement to be binding.

B. Electronic Signatures in Global and National Commerce Act (E-SIGN Act) (15 U.S.C. Chapter 96)

• This U.S. federal law gives legal validity to electronic contracts and signatures.

• The E-SIGN Act ensures that digital consent (clicking ‘I Agree’) is legally binding, just like a physical signature.

C. Uniform Electronic Transactions Act (UETA)

• This act, adopted by Wyoming and 46 other U.S. states, reinforces the legality of electronic contracts.

• UETA ensures that contracts signed online hold the same enforceability as paper contracts.

D. General Data Protection Regulation (GDPR) – Article 6(1)(b)

• The GDPR states that a platform may process user data if it is necessary to fulfill a contract.
• By signing the User Agreement, users consent to the collection, processing, and retention of their data for legal and operational purposes.
1.1.2 Scope & Applicability of the User Agreement
